Data Processing Agreement
Effective date: 2026-07-03
This Data Processing Agreement ("DPA") forms part of the agreement between you (the "Controller") and [Your Business Name] ("Processor", "we", "us", "our") for the processing of personal data in connection with [your-website.com] and our services.
Definitions
"Personal data", "processing", "controller", "processor", and "data subject" have the meanings given in applicable data protection law (such as the GDPR).
Scope and roles
The Controller determines the purposes and means of processing personal data. The Processor processes personal data only on the Controller's documented instructions, including as set out in this DPA.
Processor obligations
We will:
- Process personal data only for the purpose of providing our services and on your instructions.
- Ensure persons authorised to process the data are bound by confidentiality.
- Implement appropriate technical and organisational security measures.
- Assist you, so far as reasonably possible, in responding to data subject requests.
Sub-processors
You authorise us to engage sub-processors to help provide the services. We will impose data protection obligations on them comparable to those in this DPA and remain responsible for their performance.
Security
We maintain appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, or disclosure.
Personal data breaches
We will notify you without undue delay after becoming aware of a personal data breach affecting your data, and provide reasonable information to help you meet your obligations.
Data subject rights
We will assist you, taking into account the nature of the processing, in fulfilling your obligations to respond to requests from data subjects exercising their rights.
Return and deletion
On termination of the services, we will delete or return personal data as you direct, unless we are required by law to retain it.
Audits
We will make available information reasonably necessary to demonstrate compliance with this DPA.

Do I need a data processing agreement?
Under the GDPR, a DPA is required whenever one party processes personal data on behalf of another (for example, a SaaS vendor processing its customers' data). It sets out each party's data-protection obligations.
Is this data processing agreement template really free?
Yes — completely free. Fill in a few fields and copy or download it as Word, PDF, HTML or Markdown. No account, no email, and no paywall.
Is this template legal advice?
No. It's a plain-English starting point, not legal advice — we're a tool, not a law firm. For anything important, have a qualified lawyer review it.
Can I edit it and use it on my website?
Yes. Fill in your details, then copy the text or download the file and adjust anything you like before you publish it.
How is this different from the paid version?
This template is generic. The paid generators on policystamp.com tailor a document to your specific business type and jurisdiction and audit it for compliance gaps before delivery.
